The PYD administration excludes kidnapped members of the Kurdish National Council from the amnesty law
ARK News.. With the exception of the kidnappers of the Kurdish National Council in Syria, the PYD administration issued a general amnesty that included those who committed crimes before July 17, 2024, within specific details and procedures.
The PYD administration, on Wednesday, July 17, 2024, issued a “general amnesty” law, which includes specific details and procedures, excluding detainees of the Kurdish National Council, including politicians, activists, and media professionals.
According to Article (1) of the Amnesty Law, a general amnesty is granted for terrorist crimes and crimes against the security of the PYD administration committed by Syrians before July 17, 2024, as stipulated in the Anti-Terrorism Law No. 7 of 2021, as amended, and the General Penal Code No. 2 of 2023.
The amnesty law included, according to Article 2:
Pardoning half of the temporary prison sentence.
The life imprisonment sentence will be replaced by fifteen years' temporary imprisonment.
- For the entire life or temporary sentence of a convict who suffers from an incurable, incurable disease that makes him need the help of others to meet his personal needs.
- For the entire life or temporary sentence of a convict who has completed (75) years of age on the date of issuance of this law.
The Amnesty Law excluded in Article Three:
Leaders, princes, and trainers in terrorist organizations, and members of terrorist organizations participating in hostilities against the Syrian Democratic Forces, bombings and crimes that led to the death of a person, and the rest of the convicted perpetrators of terrorist crimes whose suitability has not been proven by a letter from the administration of the Correction and Rehabilitation Center.
- Perpetrators of the crimes stipulated in Articles No. (131 - 132 - 133 - 144 - 147) of the General Penal Code No. 2 of 2023.
- Convicts who are in hiding and fleeing from justice, unless they surrender themselves within sixty days from the date of entry into force of this law if they are within the PYD administration, and within ninety days for those outside it.
Article (4) of the Amnesty Law states: (This pardon does not affect the personal right lawsuit, and the injured party may, in all cases, file his lawsuit before the courts of justice.
Hawar News Agency said that the issuance of the amnesty law came in response to the demands of the tribal sheikhs and notables, during the second National Unity Forum for the Syrian Clans and Components, and coinciding with the anniversary of the start of the PYD’s July 19 Revolution.
Kurdish activists confirmed that ISIS benefited from the amnesty that was issued, as the amnesty did not include any member of the Kurdish National Council in Syria who was kidnapped by PYD militants.
